Opening Agenda:

 

Call to Order:                            Mayor Daffern call the meeting to order at 6:00 p.m.

 

Invocation and Pledge:               Mayor Daffern led the pledge and silent prayer.

 

 

Discussion and possible action items:

A.     To amend Ordinance No. 20100818:

AN ORDINANCE OF THE CITY OF STAPLES, TEXAS, ORDERING A SPECIAL ELECTION ON THE QUESTION OF CREATING A MUNICIPAL DEVELOPMENT DISTRICT UNDER CHAPTER 377, TEXAS LOCAL GOVERNMENT CODE, TO PLAN, ACQUIRE, ESTABLISH, DEVELOP, CONSTRUCT, OR RENOVATE ONE OR MORE DEVELOPMENT PROJECTS BENEFICIAL TO THE DISTRICT AND TO IMPOSE A SALES AND USE TAX AT THE RATE OF ONE-HALF OF ONE PERCENT FOR THE PURPOSE OF FINANCING SUCH DEVELOPMENT PROJECTS;  PROVIDING FOR THE DISTRICT TO INCLUDE ALL GEOGRAPHIC AREA WITHIN THE CITY LIMITS AND THE EXTRATERRITORIAL JURISDICTION; PROVIDING FOR THE CONDUCT OF THE ELECTION; AND PROVIDING FOR RELATED MATTERS.

 

The above referenced Ordinance needs to be amended to exclude that part of the ETJ that is in Caldwell County in order to avoid the extra election costs that would be incurred to have the Sales and Use Tax Proposition and the Staples Municipal Development District Proposition on the Caldwell County ballot as well as on the Guadalupe County ballot.  A copy of the amended ordinance would go the County Clerk and to the City Attorney for submission to the Department of Justice.  Councilmember Reinke made the motion to amend the ordinance to exclude the portion of the ETJ that is in Caldwell County.  The motion was seconded by Councilmember Huebner and the motion passed 4-0.

B.      To approve the ballot to be used in the election sent by Sue Basham, Election Administrator.  Mayor Daffern stated that he had not received the ballot at this time.

 

 

Motion to adjourn was made by Councilmember Wester with a second by Councilmember Clark.  Motion passed and meeting was adjourned at 6:06 pm.
